FINE CLASSIC AUTOS act as the Seller’s agents for the Seller except where they are stated wholly or partly to own any lot as principal and as such are not responsible for any default by Seller or Buyer.

3. Description of the Vehicle

While Fine Classic Autos makes every effort to ensure that the description of the vehicles are accurate, the ultimate responsibility for providing a true and fair representation of a vehicle lies with the Seller. The Seller may choose - but is not obligated to - purchase an independent condition report of the vehicle. In this case the inspection will be carried out by a Fine Classic Auto employee, or an authorised agent, and the vehicle description will display a label stating Independently Inspected. Potential bidders are encouraged to inspect a vehicle in person, and Fine Classic Autos will facilitate the arrangement of an inspection by putting potential Buyer and Seller in touch.

4. Exclusions and Limitations of Liability

Neither the Seller nor Fine Classic Autos make or give any guarantee, warranty, contractual promise, or assume any duty of care with regard to the description of the vehicle. Neither the Seller nor Fine Classic Autos assumes any liability (whether implied by the Sale of Goods Act 1979 or otherwise) as regards to the vehicle's manufacturer, model description, date of manufacture, condition or conformity with any description.

5. The Buyer's Undertaking

Potential bidders warrant that they have the readily available funds to cover the Purchase Price, Buyer's Premium and VAT (applied to the Buyer's Premium) should their bids be successful. Buyers understand and acknowledge that the sale constitutes a legally binding purchase contract, and accept that that they cannot avoid being personally liable to complete the purchase of a vehicle following a winning bid by claiming they are acting as an agent of a third party principal. The Buyer undertakes to pay for a winning promptly, normally within no more than seven (7) working days following the end of the auction.

6. The Seller's Undertaking

The Seller warrants that the photographs and description provided represent an accurate and fair view of the make, model and state of the vehicle. The Seller warrants being the owner of the vehicle, or duly authorised to act as an agent on behalf of a principal who is the owner of the vehicle. The Seller sells the vehicle with full title guarantee free from all liens, charges, encumbrances or third party claims. The Seller grants FineClassic Autos exclusive marketing rights until sale end date. Excepting cases of force majeure, the Seller agrees not withdraw vehicles prior to the agreed auction end date. The Seller agrees to keep the vehicle fully insured until payment into the Seller account has been received in full.

7. Risk, Property and Title

Title to the vehicle remains with the Seller until the Purchase Price, Buyer's Commission, VAT on the Buyer's Commission and any other sums payable have been paid in full. The Buyer accepts responsibility for completing and perfecting title in the lot with the relevant authorities. The Buyer assumes responsibility for insuring the vehicle as soon as his bid becomes the winning bid once the auction has ended. The Buyer accepts his responsibility to indemnify the Seller against all loss or dammage caused to the vehicle from the moment his bid becomes the winning bid until title passes on to the buyer.

8. Payment

We accept payment by bank transfer, debit card or credit card. Credit cards will be subject to a 3% invoice surcharge on the total invoice value. There is no surcharge for debit cards issued by a UK bank. Debit cards issued by overseas banks will be subject to a 3% surcharge. Payment by electronic transfer may be made to the following account, quoting the lot number and bidder ID.

9. Collection and Storage

The Buyer will not be able to collect the vehicle until payment has been made in full and in cleared funds. Once payment has been received in cleared funds, the Seller will be notified to release the vehicle to the Buyer. To ensure full security of transaction for both Seller and Buyer, payment will only be released to the Seller (minus Seller's Premium) once the vehicle is in the hands of the Buyer or his appointed transportation company.

10. Shipping

Buyers may collect the vehicle in person, or arrange to have it shipped to their preferred destination by a transporter of their choice. Shipping will be at the cost of the Buyer. Fine Classic Autos will be happy to recommend reputable transport companies.

11. Governing Law

Any disputes between the Seller and the Buyer will be settled under English law.
